Rules for Using Attractions at Kudowa Rope Park

§ 1. General Provisions

  1. These Rules define the terms of use of attractions at Kudowa Rope Park (hereinafter: “Park“) and the rights and obligations of the Service Provider and Clients.
  2. The purpose of these Rules is to ensure safety and comfort for all persons present on the premises of the Park.
  3. The management of the Park is responsible for the proper technical condition and maintenance of equipment and devices. The Park staff is responsible for conducting training and supervising the Clients.

§ 2. Participation Conditions

  1. Attractions at the Park may be used by persons (hereinafter referred to as “Clients“) who meet the age, height, health, and appropriate psychophysical conditions specified by the Park staff and displayed on informational boards.
  2. It is forbidden to use the attractions at the Park by persons under the influence of alcohol, drugs or other intoxicants or medications that may affect behavior. Clients suspected by instructors of not meeting these conditions may be asked to leave the Park premises.
  3. Before using the attractions, each Client is required to familiarize themselves with these Rules and sign a Declaration of Acknowledgment.
  4. Minors may use the attractions only with written consent from a parent or legal guardian and under their constant supervision, unless otherwise indicated by the Park staff.
  5. Using the attractions requires a valid ticket, which entitles the holder to use a specific course.

Detailed Course Requirements

  1. Blue Course – Requirements: minimum 180 cm reach with arm raised. Admission from 12 years old. Height from 4 to 15 m and requires physical fitness.
  2. Yellow Course – Requirements: minimum 150 cm reach with arm raised. Under 9 years old, admission only with a parent/guardian. The final decision on entry to the course lies with the instructor-rescuer, who will assess whether the participant meets all safety requirements.
  3. Green Course – Requirements: minimum 100 cm reach with arm raised. Admission from 3 years old.

§ 3. Rules for Using Attractions

  1. Each Client must undergo mandatory training on safety rules and equipment handling, conducted by a Park instructor.
  2. A Client should first follow the instructions of the Instructors.
  3. A Client is obliged to fully comply with the instructors’ instructions and follow the rules, use techniques learned during training, and follow instructions posted on the attractions. If the instructions are unclear or unreadable, the Client must inform the instructor.
  4. An Instructor may refuse to allow participation or require leaving the attraction in the event of adverse weather conditions, unforeseeable circumstances, or any dangerous or potentially dangerous situations for Clients or Park staff.
  5. Clients receive the necessary equipment from instructors, who assist with putting it on and taking it off at the designated area. It is prohibited to modify or remove the equipment without the instructor’s consent.
  6. Recommended attire for using the attractions is sportswear. Long hair should be tied back or fully covered by a helmet.
  7. When approaching a platform, the Client should lift slightly bent legs toward the platform. DO NOT REACH HANDS TOWARD THE MAT.
  8. Clients are forbidden from holding the steel ropes.
  9. Damaging Park property is prohibited and may result in civil and criminal liability.
  10. Clients are required to use the equipment according to the rules, with care for its condition, and return it to the instructor after use.
  11. Use of private height equipment is prohibited.
  12. Clients must check safety devices according to the instructions and instructor guidance. After each use, the Client must ensure proper application of safety equipment.
  13. Jewelry, glasses, electronic devices, and other valuables must be secured to prevent damage and ensure the safety of Clients.
  14. Clients traverse courses independently and are responsible for their own safety and that of minors under their supervision; however, this does not exempt the Park from liability for damages caused by its negligence.
  15. Only one person may be on a single line at a time.

§ 4. Liability

  1. The Park is liable for damages resulting from non-performance or improper performance of services, particularly for equipment defects, improper training, or supervisory negligence on the courses.
  2. The Client is liable for damages resulting only from their own gross negligence, especially for damages caused by intentionally disregarding the Rules or ignoring instructor instructions.
  3. The Client uses the attractions knowingly, acknowledging that it is a recreational service with an increased risk, which does not exempt the Park from liability for damages caused by its negligence.
  4. The Park is not responsible for theft or damage of items left on the premises by third parties. Items found by Park staff can be collected at the Park office within 3 days. After this period, the Park may hand the items over to the Lost and Found Office of the Kłodzko District Office.
  5. The Park does not exclude liability for clothing or property damage caused by defective equipment or staff negligence.

§ 5. Client Declaration

    1. Signing the Declaration by the Client is equivalent to confirming:
      1. Familiarity with and acceptance of these Rules.
      2. Completion of training on safety and equipment usage.
      3. No health contraindications for using the attractions.
    2. Signing the Declaration does not waive the right to claim compensation if damages result from the Park’s fault. Provisions aiming to exclude such liability are legally invalid.

§ 6. Final Provisions

      1. Use of attractions is within hours designated by the Park. Current hours are available online, at the ticket office, and on information boards. Hours may change due to organizational, weather, or technical reasons.
      2. The Park reserves the right to suspend attractions due to adverse weather or unforeseen events. Clients who must leave the attraction early for these reasons should go to the ticket office to reschedule or receive a refund.
      3. In case of fatigue, illness, or other reasons preventing continuation, notify the instructor immediately. The Client will be safely brought to the ground by the instructor.
      4. All complaints about services may be submitted in writing to the Kudowa Rope Park or via email: [email protected]. Complaints will be reviewed within 21 days of receipt.
      5. These Rules are available on the Park website and on the on-site information board.
      6. Matters not covered in these Rules are governed by Polish law.

§ 7. Copyright

    1. These Rules are protected by copyright. Copying, reproducing, or distributing their content or parts thereof without the express written consent of the Park owner is prohibited. Unauthorized use may result in legal consequences.
